“Did not vote (X) on Virginia HB 1393, an omnibus Dominion Energy bill whose data center provision allocates capacity and distribution costs to the 25 MW customer class”
The Virginia House of Delegates passed HB 1393, an omnibus Dominion Energy Virginia bill. One of its provisions concerns data centers: it directs Dominion Energy Virginia to propose to the State Corporation Commission, in any rate proceeding commencing after January 1, 2027 and before July 1, 2033, that certain costs related to capacity procurement requirements and distribution infrastructure investments be allocated to the utility customer class serving customers with contracted or measured demand of 25 megawatts or greater and an average annual load factor of 75 percent or greater - the class data centers fall into - while allowing certain manufacturing, industrial and consumer goods warehousing and distribution customers "other than data storage" to elect to remain on their existing rate schedule. CAVEAT ON POLARITY: the same bill also sets energy-assistance and weatherization funding for low-income, elderly and disabled customers, authorizes securitization of deferred fuel costs, revises standby-service tariffs and adds prevailing-wage and apprenticeship requirements. A vote on HB 1393 is not solely a vote on data center cost allocation and should not be read as one. Outcome: Passed the House of Delegates 66-31 (2 not voting). The bill went on to pass the Senate, was resolved in conference, and was signed by the Governor on May 14, 2026 as Chapter 1123. Recorded vote: X. Body: Virginia House of Delegates. Measure: VA-2026-HB1393.
