“Voted Aye on the motion directing Prince William County not to appeal the ruling against the PW Digital Gateway rezonings”
On March 31, 2026 the Virginia Court of Appeals ruled against the county in the two lawsuits challenging the PW Digital Gateway rezonings - Katy Burke, et al. v. Board of County Supervisors of Prince William County, et al., and Board of County Supervisors of Prince William County, et al. v. Oak Valley Homeowners Association, et al. (Record Nos. 1590-25-4, 1584-25-4, 1592-25-4 and 2025-24-4). The board then voted unanimously to direct the county attorney and outside counsel NOT to petition the Virginia Supreme Court for a writ of appeal. That vote ended the county's defense of the Digital Gateway rezonings and effectively killed what had been approved as one of the largest data center corridors in the world. The motion was made by Supervisor Angry and seconded by Supervisor Stewart. Note on dating: the adopted resolution PDF carries an "April 7, 2026" header line, but the county's official minutes and contemporaneous reporting place this resolution at the April 14, 2026 regular meeting; the April 14 date is used here. Outcome: Adopted unanimously, 8-0. The county declined to appeal, letting the ruling that voided the Digital Gateway rezonings stand. Recorded vote: Aye. Body: Prince William Board of County Supervisors. Measure: Res. No. 26-231.
