“Voted Aye on Tennessee HB 1847, requiring data centers to pay the full cost of the electrical infrastructure built to serve them”
The Tennessee House passed HB 1847 (companion SB 2128), which requires the owner or operator of a data center - including a proposed data center or an existing one seeking expansion - to pay the full cost of infrastructure needed to support it, requires electric utilities to conduct ratemaking so that data center infrastructure and service costs are paid solely by the data center owner or operator, bars utilities from raising rates on residential, commercial or industrial customers because of data center demand, and requires a publicly available written finding that any rate increase is not attributable to a data center. The Tennessee General Assembly's vote page does not print party, so no party is recorded for these members. Outcome: Passed the House 76-14 with one member present and not voting on April 21, 2026. The Senate substituted and passed the House bill 28-0 on April 22, 2026; the Governor signed it on May 18, 2026 and it became Public Chapter 961. Recorded vote: Aye. Body: Tennessee House of Representatives. Measure: TN-2026-HB1847.
